California Privacy Notice

This California Privacy Notice (“Notice”) applies only to California residents and supplements the Broadvoice Privacy Policy. This Notice explains the privacy rights available to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), and describes Broadvoice’s collection, use, disclosure, and processing of Personal Information as required by California law.

Except as specifically provided in this Notice, all other terms, disclosures, and practices regarding Broadvoice’s collection, use, sharing, retention, security, and protection of Personal Information are governed by the Broadvoice Privacy Policy, which is incorporated into this Notice by reference.

If there is any conflict between this California Privacy Notice and the Broadvoice Privacy Policy with respect to California residents, this California Privacy Notice will control to the extent required by applicable California law.

2. Information We Collect

  • Personal Information. In this Policy, “Personal Information” means any information relating to an identified or identifiable individual. Personal Information includes, but is not limited to, your name, physical address, email address, and telephone number.
  • Personal Information Provided by You. When you purchase or inquire about our services, buy equipment, create an account, or request information, we may collect information including your name, company name, address, email address, phone number, and payment information to service your account and respond to your feedback or requests.
  • Personal Information Collected via Automated Means. As a customer of Broadvoice and its affiliated brands, we may automatically collect information including IP address, geolocation information, calling records, voicemails, transcripts, and contact information used in call routing.
  • Third Parties. If Broadvoice obtains information, including Personal Information, from sources other than our Services or receives information from others, we will treat the combined information as Personal Information in accordance with this Policy.
  • Broadvoice Use of Information. Broadvoice may collect and use subscriber identifiable information for billing, provisioning of services, customer support, 411 directory services, 911 emergency services, demographic analysis, and to inform subscribers about products or services that may enhance their Broadvoice experience.

4. California Privacy Notice

This California Privacy Notice applies only to California residents and supplements the information contained elsewhere in this Privacy Policy.

Under the California Consumer Privacy Act (“CCPA”), California residents may have certain rights regarding their Personal Information.

a. Categories of Personal Information We Collect

  1. Identifiers, such as name, address, email address, telephone number, account name, and IP address.
  2. California Customer Records information.
  3. Commercial information regarding products or services purchased or considered.
  4. Internet or electronic network activity information.
  5. Geolocation data.
  6. Sensory information, including recordings and transcripts where applicable.
  7. Sensitive Personal Information permitted under applicable law.

b. Sources of Personal Information

  • Broadvoice customers and users;
  • Your interactions with our website and services;
  • Service providers, vendors, and business partners;
  • Publicly available sources; and
  • Other sources permitted by law.

c. Purposes of Collection

Broadvoice collects and uses Personal Information for purposes including providing, maintaining, and supporting our services; billing and account management; customer and technical support; 411 directory and 911 emergency services; security and fraud prevention; communicating with you about products and services; conducting analytics; and complying with legal obligations.

d. Categories of Third Parties to Whom Information Is Disclosed

Broadvoice may disclose Personal Information to the following categories of third parties: service providers and vendors; affiliates and subsidiaries; business partners; telecommunications and network providers; and government entities or others as required by law or to protect our rights, customers, and networks.

e. Sensitive Personal Information

Broadvoice may collect Sensitive Personal Information, such as account log-in credentials and the contents of communications where applicable.

Broadvoice does not use or disclose Sensitive Personal Information for purposes beyond those permitted under the CCPA, and California residents may request that Broadvoice limit its use of Sensitive Personal Information as described below.

f. Your California Privacy Rights

  • Right to Know: Request access to categories or specific pieces of Personal Information collected about you.
  • Right to Delete: Request deletion of Personal Information collected from you, subject to applicable exceptions.
  • Right to Correct: Request correction of inaccurate Personal Information.
  • Right to Opt Out: Request that Broadvoice not sell or share your Personal Information.
  • Right to Limit Use: Request limitations on the use of Sensitive Personal Information where required by law.
  • Right to Non-Discrimination: Broadvoice will not discriminate against you for exercising your privacy rights.

g. How to Exercise Your Rights

To submit a California privacy request, please contact Broadvoice using the information below:

Authorized Agents. You may use an authorized agent to submit a request on your behalf. Broadvoice may require the authorized agent to provide proof of authorization and may require you to verify your identity directly with us.

Verification. To protect your Personal Information, Broadvoice will take steps to verify your identity before responding to a request, which may include matching information you provide with information we maintain about you.

Response Timing. Broadvoice will confirm receipt of your request within ten (10) business days and will respond to verifiable requests within forty-five (45) days, with the possibility of a further forty-five (45) day extension where reasonably necessary and permitted by law.

8. Sharing and Disclosure of Information

Broadvoice does not trade, sell, or disclose subscriber identifiable information to third parties for marketing purposes without consent.

Broadvoice may disclose information as required by law, including in response to subpoenas, court orders, or other legal processes, or where necessary to prevent harm, fraud, or unlawful activity.

9. Unlawful Activity

Broadvoice may use subscriber identifiable information to investigate, prevent, or address activities that threaten the integrity of services, violate agreements, or may otherwise be unlawful.
